HOPfit is run by Wilfred Pieterse and a team of qualified trainers (“we”, “us”, “our”).
By clicking “I Agree” (or signing below) you confirm that:
Age & capacity – you are 18 years or older and legally competent to enter this agreement.
Health – you have consulted a medical professional, or you accept full responsibility for exercising without prior medical advice.
Voluntary participation – you join all HOPfit activities of your own free will, understanding they involve strenuous physical exertion and inherent risks of injury.
You understand and accept that exercise, boxing drills, use of equipment, outdoor or indoor venues, and travel to/from sessions all carry risks that include—but are not limited to—muscle strain, falls, collision, dehydration and, in rare cases, serious injury or death.
We draw your attention to this clause as required by section 49 of the Consumer Protection Act 68 of 2008: it limits or excludes liability for harm arising from risky activities.
To the maximum extent allowed by South African law, you:
Release HOPfit, its owners, trainers, assistants, venue operators and suppliers from any liability for loss, damage, injury or death you may suffer at or after our activities, except where caused by our gross negligence or wilful misconduct.
Indemnify and hold us harmless against any third‑party claims arising from your own actions or omissions during HOPfit activities.
If you are injured or become ill, you authorise us to obtain emergency medical treatment on your behalf. You accept responsibility for related costs.
All fees (when payable) are due as advertised. Missed sessions are non‑refundable unless we cancel. Free sessions carry the same risks and protections as paid ones.
We may photograph or film sessions for marketing. You grant us the right to use such images without compensation. You may opt out verbally or in writing before a session.
Personal data is collected only for registration, safety and communication, stored securely, and processed in line with the Protection of Personal Information Act 4 of 2013 (POPIA).
If any part of this waiver is held invalid, the remainder stays in force. South African law governs this agreement, and disputes fall under the courts of the Western Cape.
